Who you are buying from
PompPakkie is the trading name used by Daniel Culbert, operating as a sole proprietor, not as a registered company. References to “we”, “us” and “PompPakkie” mean that legal supplier.
Our website is https://pomppakkie.co.za. Contact us at hello@pomppakkie.co.za or 063 301 9738. Our physical and legal-service address is 162 Main Road, Walmer, Port Elizabeth, Eastern Cape, 6070, South Africa. Company registration number: not applicable. We are not VAT registered.
Using the store and placing an order
You must have the legal capacity, or required authorisation, to make a purchase and use the payment method provided. Supply accurate order information. Before paying, review the product, quantity, address and full order total, correct any errors or leave checkout without submitting the order.
We accept an order when payment is successfully recorded and we send an order-confirmation email. A payment confirmation is not a dispatch notice. We may carry out reasonable fraud checks and contact you if they affect fulfilment. We will not request your card PIN, banking password or one-time security code by email.
We may decline or cancel a transaction where lawful grounds exist, such as an unlawful transaction or an inability to supply. We will explain the issue and refund any payment that must be returned. These terms do not grant us an unrestricted right to cancel an accepted order merely because we change our mind.
Prices and payments
Prices are in South African rand. PompPakkie is not VAT registered and does not charge VAT. Any future change will be disclosed before new orders are placed, not added retrospectively to an accepted order.
The checkout displays the order total, including the delivery charge, before payment. Payment options are the options shown at checkout, including Yoco where displayed. Shopify hosts the storefront and checkout; the applicable payment provider processes payment authorisation. Your purchase contract is with the legal seller identified above, not with Shopify or Yoco.
If a genuine pricing or description error is identified, we will explain it and deal with it in accordance with applicable law. We will not debit an increased amount or substitute a different product without your agreement.
Products and safe use
Refer to the product page for the model, main specifications, included items and relevant limitations. Product photographs and illustrations form part of the description: we will not use them to promise materially different goods, accessories or packaging. A minor screen-colour difference does not excuse a materially inaccurate description.
Check that the product suits your vehicle and intended use. Follow the supplied product instructions and your vehicle manufacturer's guidance. If compatibility or safe use is uncertain, ask before using the product. Our products are not a promise to prevent every breakdown or a substitute for professional assistance where it is needed.
These precautions do not shift responsibility for a faulty product, inadequate warning or inaccurate description onto you. Nothing in these terms excludes non-excludable consumer rights or liability, including liability that the law preserves for unsafe products, fraud, gross negligence or personal injury.
Delivery, cancellation and returns
The Shipping Policy and Returns and Refunds Policy form part of these terms. A manufacturer or upstream supplier's warranty does not reduce our legal obligations to you. Where a term conflicts with a mandatory legal right, the legal right prevails.
Order records
We provide an order confirmation electronically. Save or print it with the policies that applied when you purchased. You may request a copy of your transaction record from hello@pomppakkie.co.za for five years after the purchase, subject to reasonable identity verification and any longer retention required by law. We may need your order number, purchase date and the email used for the order to locate it.
Store content and lawful use
You may view, save or print store information for your own shopping and records. Commercial reuse of our original content requires permission unless the law permits it. Third-party trademarks remain with their owners. Do not misuse the checkout, submit malicious code, attempt unauthorised access or interfere with another customer's use of the store.
Complaints and applicable law
Send a complaint to hello@pomppakkie.co.za, with your order number and the outcome you are seeking. We will investigate and respond without unreasonable delay. Raising a complaint with us does not remove access to an appropriate industry ombud, the National Consumer Commission, tribunal or court, subject to the applicable jurisdiction and legal procedure. South African law applies, without excluding mandatory protections that apply to a particular transaction. We do not require you to waive statutory remedies or agree to compulsory private arbitration.
Changes to these terms
The terms displayed when your order is accepted apply to that order. Later changes apply prospectively unless a legal requirement or an agreement with you requires otherwise. We will update the date when these terms change.
